Welcome to Kismet ("the Platform"), operated by Kismet Travel Ltd ("Kismet", "we", "us"). By using this Platform, you agree to these Terms of Service. If you do not agree, please do not use the Platform.

Description of Service

The Platform provides:

• Browsable vacation rental listings with property details, amenities, photos, and location information
• Real-time availability and pricing from property management systems when connected
• AI-powered "Plan in" links that let you research properties through AI assistants (ChatGPT, Claude, Perplexity, Google AI, Gemini)
• Direct links to property booking pages to complete reservations

Important: The Platform is informational. We do not process bookings, payments, or reservations directly. All bookings are completed on the property manager's booking platform.

Acceptable Use

You agree to use the Platform only for:

• Browsing and researching vacation rental properties
• Checking availability and pricing
• Using AI planning tools to research potential stays
• Following booking links to complete reservations

You agree NOT to:

• Use the Platform for automated scraping, data mining, or bulk queries beyond normal browsing behavior
• Attempt to reverse engineer or extract data systematically
• Use the Platform for any illegal or unauthorized purpose
• Interfere with or disrupt the Platform or servers hosting it

Information Accuracy

We strive to provide accurate and up-to-date property information. However:

• Rates and availability are subject to change without notice
• Property details, photos, and amenity descriptions are provided by property managers and may not always be current
• Final pricing, availability, and booking confirmation occur on the property manager's booking platform, not through Kismet
• AI assistants accessed via "Plan in" links may interpret property information differently or provide their own analysis

The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation.

Limitation of Liability

To the fullest extent permitted by law, Kismet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Platform
• Errors, inaccuracies, or omissions in property information
• Any booking issues, pricing discrepancies, or availability conflicts on third-party booking platforms
• Actions taken based on AI assistant recommendations accessed through our "Plan in" links

Booking and Reservations

When you follow a booking link from a property listing, you leave Kismet and interact directly with the property manager's booking platform. All bookings are subject to:

• The property manager's own terms and conditions, cancellation policies, and privacy policy
• Availability and pricing confirmation at time of booking
• Payment processing and security policies of the booking platform

Kismet is not responsible for the booking process, payment handling, cancellation policies, or any disputes arising from reservations made through third-party booking platforms.

Third-Party AI Platforms

The Platform provides "Plan in" links to third-party AI assistants (ChatGPT, Claude, Perplexity, Google AI, Gemini). When you use these links, property information is passed to the AI platform for your convenience. Your use of those platforms is governed by their respective terms of service and privacy policies, which are independent of these Terms.

Intellectual Property

All content, features, and functionality of the Platform (including but not limited to software, design, and the Kismet brand) are owned by Kismet Travel Ltd and are protected by copyright, trademark, and other intellectual property laws. Property descriptions, photos, and listing content are owned by their respective property managers.

Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

Termination

We reserve the right to suspend or terminate access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, property managers, or Kismet.

Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ireland.
